Can a nigerian dwarf goat be considered a pygmy goat?

Where I live, the county ordinance states as followed:

Pygmy goats, with a height of less than twenty-four (24) inches, shall be considered to be a household domestic pet and are permitted in conjunction with the residential use of property. Except where otherwise permitted, there shall be no more than two (2) adult (over the age of four (4) months) pygmy goats kept on any legal lot.

Would a nigerian dwarf goat, with a height of less than twenty-four inches, be included in this ordinance?

  • When I went to buy my first goats, the woman raised both NDs and pygmies, and I kept asking which was which, and after a few I was trying to guess and getting it wrong! Now I shudder at the thought! :)

  • We worded our code to read "under 100 pounds at maturity" with no mention of breed; that included all miniature ivestock.  As Deborah said, your local officer wouldn't know the difference.  The only way would be *if* he raises registered NDs himself.  To most people, a goat is a goat is a goat.  The code is poorly written.  At some point in the future, when they review it, see if you can get on the committee; that is what I did and it paid off, big time.

  • Ditto on everything Rachel said. I'm sure your local code enforcement officer couldn't differentiate between a pygmy and a ND if his/her life depended on it.

  • I'm not a lawyer, but I would say that size is what matters more than breed, and this instance, your ordinance is just poorly written by someone that doesn't understand pygmy is also a goat BREED, and not just a reference to size. IMO, pygmy is being used in this ordinance to indicate size rather than breed. 

    SO. My answer to your question would be, YES. I think that Nigerians fitting the size requirement would be included.
